China court upholds death sentence for Canadian drug dealer Schellenberg

On August 10, 2021, the Higher People’s Court of Liaoning Province filed a second-instance public verdict on the Canadian defendant Robert Lloyd Schellenberg’s drug smuggling case on August 10, 2021, ruled that the appeal was rejected, upheld the original verdict, and reported to the Supreme People’s Court for approval in accordance with the law, according to the official Weibo news of the High People’s Court of Liaoning Province, China.

The Intermediate People’s Court of Dalian City, Liaoning Province found that the defendant Robert Lloyd Schellenberg participated in organized international drug trafficking activities and smuggled 222.035 kilograms of methamphetamine with others, which constituted the crime of drug smuggling. According to the facts, nature, circumstances of the crime committed by the defendant and the degree of harm to the Chinese society, the defendant Robert Lloyd Schellenberg was sentenced to death for drug smuggling, and all personal property was confiscated.

After the sentence was pronounced, the defendant in the original trial, Robert Lloyd Schellenberg, refused to accept and filed an appeal. The Higher People’s Court of Liaoning Province of China formed a collegiate panel in accordance with the law to open a court session to hear the case. It held that the facts found in the first instance were clear, the evidence was reliable and sufficient, the conviction was accurate, the sentencing was appropriate, and the trial procedures were legal.

During the trial of the second instance, the Chinese court protected the appellant Schellenberg’s defense and the use of his native language to participate in litigation and other rights, listened to the defense opinions of the defender, and hired two translators for him.
