Muji fined in China for unhealthy kids’ clothes and expired food

According to China’s National Enterprise Credit Information Publicity System, MUJI (Shanghai) Commercial Co., Ltd. was recently confiscated 1229.88 yuan of illegal income and fined 38,343.74 yuan for “selling products that do not meet the national, industry, and local standards (regulations only) that protect human health, personal and property” by Jing’an District Market Supervision and Administration Bureau.

After inquiry, it was found that the above-mentioned administrative penalty was caused by the unqualified sampling inspection of 2 batches of MUJI children’s clothing. On the day after the administrative penalty occurred, MUJI was again punished by the Huangpu District Market Supervision Bureau for quality problems. In addition, MUJI has frequent quality problems and has been punished by the Chinese market regulators four times since September last year.

Muji is fined for selling 2 batches of unqualified kids’ clothes

After inquiring the Shanghai Municipal Market Supervision Administration website, it was found that the Jing’an District Market Supervision Administration issued an administrative penalty on April 29. The punishment object, the type of illegal activity, and the amount of the fine were all consistent with the above-mentioned case.

The details of the case on April 29 showed that the products of MUJI (Shanghai) Commercial Co., Ltd. were judged to be unqualified in the product quality supervision and random inspection organized by the Guangzhou Municipal Market Supervision Administration in 2020. The clues mentioned above were transferred by the Guangzhou Municipal Market Supervision Administration to Jing’an District Market Supervision Administration for processing. On February 5, 2021, the Jing’an District Market Supervision Administration filed an investigation on the party concerned.

On August 12, 2020, Muji light pants (children’s navy blue) and Muji suspend skirts (children’s suspend skirts, hereinafter referred to as suspend skirts), which were sold by the Muji (Shanghai) Commercial Co., Ltd., Guangzhou Liwan Branch located in the basement floor, Room B191, No.8 Huangsha Avenue, Liwan District, Guangzhou City, were inspected in the clothing product quality supervision and spot check organized by Guangzhou Municipal Administration of Market Supervision.

On September 3, 2020, the “Inspection Report” issued by Guangzhou Inspection, Testing and Certification Group Co., Ltd. showed that the above two products were sampled and tested, and the color fastness to wet rubbing did not meet the requirements of the GB31701-2015 Class B standard. The product quality was judged to be unqualified. Afterwards, MUJI submitted a re-inspection, and the results of the re-inspection were all unqualified.

The details of the case show that the light pants and suspender skirt products involved were sold in 149 and 282 pieces respectively, and the total value of the two products was RMB 38,343.74. During the period when the parties sold the aforementioned products, the input tax was deducted and the value-added tax was not paid, so the illegal income was determined to be RMB 1,229.88. The Jing’an District Market Supervision and Administration Bureau imposed administrative penalties on MUJI in accordance with the law of “ordering to stop selling the products involved in the case, confiscating the illegal income of 1,229.88 yuan, and fined 38,343.74 yuan”.

On the day after the above-mentioned administrative penalty case was released, MUJI (Shanghai) Commercial Co., Ltd. was again administratively punished by Shanghai Huangpu District Market Supervision and Administration Bureau. The content of the administrative penalty is “a fine of 3,900 yuan and an order for correction”.

Since 2020, MUJI has been fined 4 times for quality problems in China

Public information shows that MUJI is a Japanese grocery brand that was born in 1980 and officially entered the Chinese market in July 2005. Currently, it has opened more than 200 stores in China. According to Tianyancha data, MUJI (Shanghai) Commercial Co., Ltd. has a registered capital of 29 million US dollars. The company was established in May 2005. The legal representative is Shimizu Chi, and the company is the sole shareholder of the company.

This is not the first time that MUJI has been fined for product quality problems. Since its establishment, MUJI (Shanghai) Commercial Co., Ltd. has been punished by regulatory authorities 13 times. Since September last year alone, MUJI (Shanghai) Commercial Co., Ltd. has been punished by the market supervision department 4 times due to product quality problems:

On September 22, 2020, the Jing’an District Market Supervision Administration imposed an administrative penalty of confiscation of 5053,75 yuan of illegal income, a fine of 21,069 yuan, and an order for correction of Muji for “producing and selling substandard products as qualified ones”;

On October 28, 2020, Muji was imposed by the Jing’an District Market Supervision and Administration Bureau of Shanghai for confiscation of illegal income of 7.33 yuan and a fine of 50,000 yuan for “the production and operation of food and food additives marked with false production dates, shelf life or beyond the shelf life”.

On April 2, 2021, the Jing’an District Market Supervision Administration imposed an administrative penalty of confiscation of illegal income of RMB 2979.6 yuan, a fine of RMB 12,733.32 yuan, and an order to stop the illegal act by Muji for “passing substandard products as qualified products”.
