If you source nonstick cookware, waterproof outdoor apparel, or food packaging from China to sell in the US or EU, you’ve likely seen the phrase “PFAS ban” more than once. But the real picture is far more complicated than most headlines suggest: the EU’s unified restriction hasn’t finalized yet, while the US has no federal ban at all but a growing patchwork of state laws already partially in effect — and even within one country, the same product category can get an unexpected carve-out (nonstick cookware in France, notably). This article maps out where things actually stand today, and how to talk to your suppliers about alternatives.

1. What PFAS is, and why it touches so many categories

PFAS (per- and polyfluoroalkyl substances) is a family of over 10,000 synthetic chemicals, prized for extreme stability — earning them the nickname “forever chemicals” because they barely break down. Their water-, oil-, and stick-resistant properties make them common in nonstick cookware coatings (PTFE, branded as Teflon), waterproofing treatments for outdoor apparel, food packaging liners, and cosmetics. Research has linked some PFAS to endocrine disruption, immune effects, and cancer risk — the underlying driver of tightening regulation worldwide.

2. A surprising, real contrast worth knowing: France “banned PFAS” — but nonstick cookware was exempted

This is the single most useful case study here. France’s PFAS law, passed February 2025 and effective January 1, 2026, bans PFAS in cosmetics, apparel textiles (excluding protective clothing), and footwear — but nonstick cookware (PTFE-coated pans and pots) was explicitly excluded via a parliamentary amendment, following lobbying from Groupe SEB, parent company of the Tefal brand. If you only read the headline “France bans PFAS,” you’d reasonably assume nonstick cookware is included — it currently isn’t. The ban extends to all textiles (excluding specified industrial uses) only from 2030, and whether cookware eventually gets caught depends on whether the EU’s broader restriction (if adopted in 2027) covers the category.

3. EU level: the unified restriction is still pending — but food packaging already has a binding limit right now

  • The EU’s REACH-wide PFAS restriction proposal: submitted by Germany, Denmark, the Netherlands, Norway, and Sweden in 2023, covering roughly 10,000 PFAS substances. It’s currently in evaluation (ECHA’s scientific committees expect to conclude review in the first half of 2026), and the European Commission isn’t expected to make a final decision until 2027. If adopted, most sectors get an 18-month transition; sectors with genuinely no substitute could get derogations up to 13.5 years — but consumer nonstick cookware is unlikely to qualify, since viable substitutes (like ceramic coatings) already exist in the market.
  • One thing is already in force, though: the EU’s Packaging and Packaging Waste Regulation (PPWR), effective February 2025, sets a real PFAS limit for food-contact packaging — if total organic fluorine exceeds 50 mg/kg, the manufacturer/importer/downstream user must provide proof of the fluorine’s source. If you’re in food packaging, this is a live constraint today, not a “possible future” one.

4. The US: not one federal law, but a rapidly expanding state-by-state patchwork

This is structurally different from the EU’s approach. The US has no unified federal ban on PFAS in consumer products — instead, 18 states have enacted their own laws, each with different scope, effective dates, and thresholds, with new states and rules added every year:

  • Minnesota was the first US state to ban PFAS cookware sales (from January 2024); its reporting regime (Amara’s Law) requires initial filings by July 1, 2026.
  • Colorado, Maine, and Vermont banned PFAS cookware and cleaning products from January 1, 2026; Vermont uses a concentration-threshold approach — currently 100 ppm, dropping to 50 ppm in July 2027.
  • Washington State banned PFAS in indoor leather/textile furniture from January 2026, with reporting requirements for certain products (first reports due January 31, 2027) at a 50 ppm total organic fluorine threshold.
  • New Mexico and New Jersey phase in cookware and food packaging bans in 2027–2028.
  • Connecticut requires PFAS labeling disclosure for outdoor apparel and firefighting gear from January 2026, expanding to broader bans from July 1, 2026.

What this means for you: you can’t just check “is there a federal ban” — you have to check the specific states you’re selling into individually. The same product might already be unsellable in Minnesota while being completely fine in a state without legislation yet.

5. China has its own domestic controls too — a useful starting point, not a substitute for target-market compliance

China is a signatory to the Stockholm Convention and bans production of PFOA, PFOS, and PFHxS at the source. There are also specific product standards: GB/T 21295-2024 sets PFOA/PFOS limits for water/oil-resistant and easy-clean treated textiles, and GB/T 39498-2020 provides guidance on controlling PFOS, PFOA, and other C8+ perfluorocarboxylic compounds in consumer products. This means your supplier may already have some compliance foundation — but as with other categories, don’t assume meeting China’s domestic standard automatically satisfies EU or US requirements, since the exact substances and thresholds covered don’t necessarily align.

6. Specific alternatives worth asking your supplier about

  • Nonstick cookware: ask whether a ceramic coating (based on Si-O bond structures) is available — this PFAS-free alternative has matured in appearance and nonstick performance and is well-accepted in the market.
  • Outdoor apparel waterproofing: ask whether fluorine-free durable water repellent (DWR) finishes are used (silane-based, quaternary-ammonium-based, or fatty-acid-based), rather than traditional fluorinated treatments. Industry leader GORE-TEX is transitioning its main consumer products to a PFAS-free ePE (expanded polyethylene) membrane — a useful reference point for what the industry considers a credible technical path.
  • Food packaging: directly require a total organic fluorine test report from the supplier, checked against your target market’s specific ppm limit (the EU’s PPWR sets 50 mg/kg; US state thresholds range from 50 to 100 ppm).
  • Label verification: watch for suppliers proactively labeling products “fluorine-free” or “PFAS-free” — but as with other categories, the claim itself isn’t proof; require the test report behind it.

The bottom line

PFAS regulation is a fast-moving, fragmented patchwork — the EU’s unified restriction hasn’t finalized (expected 2027), though food packaging already faces a real binding limit today; the US has no federal ban, just 18 states each legislating on their own timelines and thresholds; and even within one country, lobbying can carve out surprising exceptions (France’s cookware exemption).
